General Conditions of Online Sale

The conditions set out below are effective exclusively between the company Sei Srl , with registered office in Corso Martiri della Libertà 22, 95131 Catania (CT) – VAT number 06129110877 (hereinafter referred to as Sei Srl ) and any person (hereinafter referred to as the “CUSTOMER”) who makes online purchases on the website www.mabash.it, in accordance with the provisions of the Consumer Code, pursuant to Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree 70/2003, regarding e-commerce. These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.

ARTICLE 1 – Object of the contract

The contract concerns the sale, by Sei Srl, of the products published on the website www.mabash.it, where the name of the item and its essential characteristics are expressly indicated.
Sei Srl offers for sale exclusively original and authentic products.
Although Sei Srl constantly takes measures to ensure that the images displayed on the Site are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations are always possible due to the technical characteristics and color resolution of the computer you are using. Consequently, the Seller will not be responsible for any inadequacy of the graphic representations of products displayed on the Site due to the aforementioned technical reasons, since such representations are merely for illustrative purposes.

The data and prices published on the site may be subject to changes or updates in order to provide better service to the CUSTOMER; any changes will be promptly communicated upon confirmation of the order.
Before confirming their order, the customer undertakes to review these general conditions of sale, particularly the pre-contractual information provided by Sei Srl, and to accept them by checking the box provided. In the order confirmation email, the CUSTOMER will also receive a link to download and archive a copy of these general conditions of sale, as required by art. 51, paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

ARTICLE 2 – Pre-contractual information for the consumer – art. 49 of Legislative Decree 206/205

Before the purchase contract is concluded and before the order is validated with an "obligation to pay", the CUSTOMER is informed in accordance with the provisions of Article 49 of the Consumer Code and, among other things, of:

    • main characteristics of the property;
    • identity of the seller, as well as address and contact details;
    • total price of the goods including taxes, with details of shipping costs and any other costs;
    • payment method;
    • deadline by which Sei Srl undertakes to deliver the goods;
    • conditions, terms and procedures for exercising the right of withdrawal (art. 7 of these conditions) as well as the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 206/2005;
    • information on the costs that the CUSTOMER will have to bear in the event of returning the goods;
    • existence of the legal guarantee of conformity for the goods purchased.

In any case, the CUSTOMER may, at any time and in any case before the conclusion of the contract, access information relating to Sei Srl, such as its geographic address, telephone number, and email address. This information is also provided below:

ARTICLE 3 – Conclusion and effectiveness of the contract

It is not possible to conclude the contract exclusively online, by the CUSTOMER accessing www.mabash.it and placing a purchase order according to the procedure provided on the website. Specifically, the sales contract is considered concluded when Sei Srl sends the CUSTOMER an order confirmation email. The email contains the CUSTOMER's information and order number, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent.

The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to Sei Srl.

ARTICLE 4 – Product availability

Product availability refers to the actual availability at the time the CUSTOMER places the order. However, this availability should be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products may be sold to other CUSTOMERS before the order is confirmed.

Even after Sei Srl has sent the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, Sei Srl will contact the CUSTOMER to work together to find the most suitable solution. If, in this latter case, an agreement cannot be reached, the CUSTOMER may request cancellation of the order, thereby terminating the contract. Sei Srl will refund any amount already paid within 14 days of Sei Srl becoming aware of the CUSTOMER's decision to terminate the contract.

ARTICLE 5 – Prices

All product prices listed on the www.mabash.it website are in Euros and include VAT. Shipping costs are not included in the purchase price, but are indicated and calculated at the time of ordering.

The CUSTOMER accepts Sei Srl's right to modify its prices at any time; in any case, it is understood that the goods will be invoiced based on the prices indicated on the website at the time the order is created and indicated in the confirmation email sent by Sei Srl to the CUSTOMER.

In the event of an IT, manual, technical, or any other error that results in a substantial change, unforeseen by Sei Srl, in the retail price, making it exorbitant or clearly negligible, the purchase order will be considered invalid and canceled, and any amount paid by the CUSTOMER will be refunded within 14 days of the cancellation date.

ARTICLE 6 – Payment methods

All payments by the CUSTOMER may only be made using the credit cards listed on the website www.mabash.it, and other payment methods such as PayPal, Stripe, and Bank Transfer.
Communications relating to the payment and the data communicated by the CUSTOMER at the time the payment is made will be carried out on special protected lines.

ARTICLE 7 – Right of withdrawal

For purchases made, it will always be possible to exercise the right of withdrawal pursuant to the Consumer Code (Legislative Decree 21.02.2014 No. 21, published in the Official Journal 11.03.2014) within 14 (fourteen) calendar days of delivery of the goods, by contacting customer service for return procedures. The goods must be returned at the consumer's expense within 14 (fourteen) calendar days from the date on which the consumer communicated his or her decision to withdraw to Sei Srl.

Sei Srl will only accept returns of goods in perfect condition and in their original packaging, accompanied by the relevant purchase invoice. If the returns are made in accordance with the above, Sei Srl will issue a refund in the form of a credit to the customer for future purchases, within a maximum of 14 (fourteen) days of receiving notification of the withdrawal. Sei Srl may withhold the refund until it receives the goods. The consumer is solely responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Sei Srl will also refund the relevant shipping costs invoiced with the purchase.

ARTICLE 8 – Product guarantees and non-conformity

Delivery of Products: upon delivery of the Products to the Customer by the carrier responsible for their transport, the Customer must check, in the presence of the carrier: The Products offered on the Site comply with the national and EU legislation in force in Italy.
All Products sold on the Site are covered by the Legal Guarantee of Conformity provided for by Articles 128-135 of the Consumer Code ("Legal Guarantee"). The Legal Guarantee is reserved for consumers. In the event of receiving products that do not conform to orders or are damaged, the CUSTOMER has the right to have the product restored to conformity free of charge by replacing it or, if stocks are out of stock and upon agreement with the Customer, with a product of equivalent value. Rights under the legal guarantee of conformity may be exercised provided that the Products have been used correctly, with due diligence and in compliance with their intended use and the provisions of the enclosed instructions, and upon presentation by the Customer of the delivery note and the order number.

ARTICLE 9 – Delivery methods

Sei Srl undertakes to deliver the goods EXCLUSIVELY within the European Union. Sei Srl undertakes to deliver the goods, via courier, to the address indicated by the CUSTOMER at the time of ordering, within 20 days from Sei Srl's sending of the order confirmation email to the CUSTOMER.

Upon delivery of the Products to the Customer by the carrier responsible for their transport, the Customer must check, in the presence of the carrier:

    • that the quantity and type of Products ordered correspond to those indicated in the transport document;
    • that the packaging used for transport is intact, not damaged, wet or otherwise altered, even just in the sealing materials;
    • that the quantity and type of Products delivered correspond to what was ordered.

Any anomalies or discrepancies must be reported immediately to the carrier upon receipt of the Products, by indicating them on the delivery note.

Assistance:
For any assistance or complaint relating to the Products, the Customer must contact Sei Srl at the contact details indicated in the following point 2 of the General Conditions of Sale.
For every order placed on the website www.mabash.it, Sei Srl will issue a receipt for the shipped goods. The receipt will be attached to the shipment or sent by email. Upon request, the customer can request an invoice by sending an express request to shop@mabash.it, specifying their personal details and tax code and/or VAT number, along with any certified email address or recipient code. The invoice will then be sent to the exchange system.
The receipt or invoice will contain all the information provided by the CUSTOMER during the purchase procedure.
Once the receipt or invoice has been issued, it will no longer be possible to make any changes to the data indicated therein.

ARTICLE 10 - Responsibility

Sei Srl assumes no responsibility for disruptions due to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions or disruptions, in the event that it is unable to fulfill the order within the expected timeframe. Sei Srl is not responsible for the actions of the courier transporting the goods in the event of a delay in delivery or damage to the goods.

ARTICLE 11 – Access to the site

The CUSTOMER has the right to access the site for browsing and making purchases. Any other use, particularly commercial, of the site or its content is not permitted. All elements of this site, whether audio or visual, and the related technology used remain the property of Sei Srl and are protected by intellectual property rights.

ARTICLE 12 – Cookies

The website www.mabash.it uses cookies. Cookies are electronic files that record information about the CUSTOMER's browsing on the site (pages viewed, date and time of viewing, etc.) and allow Sei Srl to offer a personalized service to its customers.
Sei Srl informs the customer that they can disable the creation of these files by accessing their internet settings. It is understood that disabling cookies will prevent the CUSTOMER from making online purchases.

ARTICLE 13 – Provision and processing of personal data

Sei Srl undertakes to collect personal data for the sole purpose of registering the CUSTOMER and activating the order fulfillment process; the data will be processed in compliance with applicable legislation. The CUSTOMER consents to the processing of personal data for the purpose of fulfilling the order.

ARTICLE 14 – Integrity

These general conditions of sale constitute the entirety of the clauses that comprise them. If one or more provisions of these general conditions of sale are held invalid or declared as such pursuant to law, regulation, or following a decision by a court of competent jurisdiction, the other provisions will remain in full force and effect.
